The 21st Century Cures Act – What Providers Need to Know About New EVV Requirements

In December 2016, Congress passed the “21st Century Cures Act”, a sweeping legislative package that includes new funding and resources to address a wide variety of medical topics, including the opioid epidemic, the FDA drug approval process, medical research, and behavioral health issues. Importantly for providers, it also includes new requirements for electronic visit verification (EVV) and a penalty for non-compliance starting in 2019. EVV is a system that requires providers to confirm that services were actually delivered and to do so through a possible variety of electronic methods for each service like a phone call, electronic signature, and so forth. Join us for an overview of the law’s major provisions, detailed information on the EVV requirements that will impact your agency, and how to get involved early on in the process of implementation to ensure that the provider voice is heard.

Katherine Berland, Director of Public Policy, ANCOR
Katherine Berland, Esq., is ANCOR’s Director of Public Policy. Prior to joining ANCOR, she worked in the financial industry, first as a registered investment representative, then for a national bank working in consumer banking and commercial lending. She left the bank to pursue a law degree in 2005. While in law school, she worked as a law clerk for a D.C. firm specializing in insurance tax law. She graduated from Georgetown University Law Center in 2009 and worked for several years as an attorney doing litigation preparation. She has done extensive volunteer work with organizations including Human Rights Watch, Human Rights Campaign, and Habitat for Humanity. For ten years she served as coordinator for the local Amnesty International chapter in Howard County, Maryland. She joined ANCOR in December 2012. She lives in Maryland with her husband and three children.

Dr. Laura Brackin is a leading expert in the disability field.  Previously, she served as Assistant Secretary for the Department of Health and Hospital, Office for Citizens with Developmental Disabilities in Louisiana; Executive Director of The Arc of Louisiana; Assistant Professor and Program Director for the University Center for Excellence in Developmental Disability Education, Research, and Service; and Executive Director of the Governor’s Office of Disability Affairs under the Foster Administration.  Her consulting firm, Brackin and Associates, provides legislative and public policy consulting services, training, and technical assistance to disability organizations and managed care organizations. Dr. Brackin holds a doctoral degree in Educational Leadership and Research from Louisiana State University.

Alyssa Schafer is the Consumer Directed Services (CDS) Compliance Coordinator at Paraquad in St. Louis, Missouri.  She has been with Paraquad for 7 years and holds a Bachelor’s of Social Work degree.  She has been involved with Paraquad’s EVV project since Missouri initiated the pilot project to assess the efficacy of EVV with the CDS program. She is responsible for maintaining Paraquad’s EVV database and ensuring the agency’s EVV system is in compliance with applicable state laws.
